1. INTRODUCTION AND DEFINITIONS

Bloxino.com ("we, us, our, ours, etc.") is the owner and operator of www.bloxinox.com and any affiliated websites and related mobile versions ("Bloxino"). Bloxino is an entertainment platform that allows users to play a variety of games ("Games") using an internal virtual currency ("BT"). BT may be purchased using either cryptocurrency or Robux, and, regardless of how they were obtained, may be cashed out only as Robux, as set forth in these Terms of Service. These Terms of Service are a legal contract that establishes the relationship between you, the user, ("you, your, yours, etc.") and us as it relates to the services we provide to you through Bloxino ("Services"), including all text, images, graphics, photographs, audio, video, buttons, icons, animations, data, messages, software, and other content, information, or materials on Bloxino ("Materials"), and any Materials posted to or otherwise shared on Bloxino by you ("Content").

Bloxino is not affiliated with, endorsed by, or sponsored by Roblox Corporation. "Roblox," "Robux," and all related names, marks, and logos are trademarks of Roblox Corporation, used herein solely for identification purposes.

As used in these Terms of Service:

"BT" (short for "Bloxino Tokens") means the internal virtual currency on Bloxino. BT may be purchased using either cryptocurrency or Robux. BT are for entertainment purposes only and have no independent cash value. All BT are a single currency regardless of how they were obtained, and may be cashed out only as Robux, as described in Section 8.

"Cryptocurrency" means any digital or virtual currency accepted by Bloxino from time to time, including Bitcoin and Ethereum, and such other cryptocurrencies as may be displayed on Bloxino.

"Games" means the chance-based entertainment games offered on Bloxino from time to time.

"Robux" means the virtual in-game currency used by players of the Roblox platform.

"Roblox" means the online platform operated by Roblox Corporation, an independent third party with no affiliation to Bloxino.

2. ACCEPTANCE

By accessing Bloxino or using the Services, you accept and agree to these Terms of Service, and you certify to us that (i) you are eighteen (18) years of age or older and are at least the age of majority in your jurisdiction, (ii) you are not a resident of any jurisdiction where cryptocurrency transactions or online gaming of this nature are prohibited, (iii) you have the legal capacity to enter into and agree to these Terms of Service, (iv) you are using the Services freely, voluntarily, willingly, and for your own personal enjoyment, and (v) you will only provide accurate and complete information to us and promptly update this information as necessary to maintain its accuracy and completeness.

3. RIGHT TO REVISE

We reserve the right to revise these Terms of Service at any time. You agree that we have this unilateral right, and that all modifications or changes are in force and enforceable immediately upon posting. The updated version supersedes any prior versions immediately upon posting, and the prior version is of no continuing legal effect. We agree that if we change anything in these Terms of Service, we will change the "Last Updated" date at the top of these Terms of Service. You agree to re-visit this page on a frequent basis, and to use the "Refresh" button on your browser when doing so. If the "Last Updated" date remains unchanged from the last time you reviewed these Terms of Service, you may presume that nothing has changed. If the "Last Updated" date has changed, you must review the updated Terms of Service in their entirety. You must agree to any updated Terms of Service or immediately cease use of Bloxino. We are not responsible for your neglect of your legal rights.

4. NOT A GAMBLING SERVICE

We are not a gambling service, we do not take or place illegal bets, and we do not recommend or encourage illegal gambling. Instead, we offer entertaining online Games that fall outside the prohibitions imposed by state and federal gambling laws. Bloxino operates a single virtual currency system in which all BT are the same currency regardless of how they were obtained, and in which all winnings and cash-outs are paid exclusively in Robux. This structure removes an essential element of gambling:

(A) All Payouts Are Virtual (Virtual-to-Virtual Payout Model). Regardless of whether BT were purchased with Robux or with cryptocurrency, BT can only ever be cashed out as Robux. Because Robux is a virtual currency with no real-world cash value under the Roblox Terms of Use, nothing of real-world value is at stake or can be won at any point. The "prize" element required for gambling is therefore absent; there is no prize of real-world value that a user can win.

(B) Cryptocurrency Is a Purchase Method Only. Cryptocurrency may be used solely to purchase BT. BT cannot be withdrawn, converted, or paid out as cryptocurrency, and no user can win or receive cryptocurrency through the Services.

You agree not to use the Services if doing so would violate the laws of your state, province, or country. It is your sole and absolute responsibility to comply with all applicable laws, and you assume all risk in using the Services. We bear no responsibility for your use of the Services in connection with illegal activities. The Services are for entertainment purposes only.

5. ACCOUNTS

5.1 Registration

All users may create a single account on Bloxino by providing a valid email address and creating a password, or by signing in using their Roblox log-in credentials, provided you meet the requirements set forth herein. To purchase BT with cryptocurrency, you must provide a valid cryptocurrency wallet address. To purchase BT with Robux, you must have a valid Roblox account with sufficient Robux. We may require you to provide certain age and/or identity verification documentation, including a copy of a government-issued identification card. Identity verification is required after five hundred dollars ($500 USD) equivalent in cumulative cryptocurrency deposits. Acceptance of registration is subject to our sole discretion.

5.2 Accuracy

If you provide any false, misleading, inaccurate, incomplete, or otherwise incorrect information to us, or if we have reasonable grounds to suspect that a violation of this provision has occurred, we have the right to suspend or terminate your account and refuse any and all current or future use of Bloxino, as well as subjecting you to criminal and civil liability.

5.3 No Account Sharing

You will not use or attempt to access any third party's account at any time. You will not allow any third party to access or use your account at any time, nor provide any third party with your login credentials. We will not be liable for any loss that we may incur as a result of any third party that uses your password or otherwise accesses your account, either with or without your knowledge. You will be liable for losses incurred by us or any third party due to release of account credentials to unauthorized persons.

5.4 Termination by You

You may request deletion of your account by contacting us. If your account is deleted, you will forfeit all rights and interests in your account, including any BT remaining in your account. You should cash out any BT before requesting deletion. You will not assign, transfer, or sell your account.

5.5 Termination by Us

We may suspend or delete your account or any licenses herein at any time, for any reason, in our sole discretion. If we suspend or terminate your account for cause (including a breach of these Terms of Service), you forfeit all rights and interests in your account, including any BT remaining in your account. If we suspend or terminate your account for any other reason, we may, in our sole discretion, permit you to cash out any BT remaining in your account as Robux, as set forth in Section 8.

6. GRANT OF RIGHTS

6.1 Materials

We grant you a limited, nonexclusive, revocable, and nontransferable personal license to access Bloxino and use the Services and the Materials for private, non-commercial purposes on a single computer or mobile device. Your license to access Bloxino and use the Services is not a transfer of title. You will not copy or redistribute any Materials, and you will prevent others from unauthorized access to or copying of the Materials.

6.2 Content

You retain all ownership rights in any Content you submit to Bloxino. However, you grant us a worldwide, perpetual, nonexclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content for our business (and the business of our successors), including for promoting and redistributing any part of Bloxino in any media formats and through any media channels. We may freely use this Content for any purpose.

7. ACCEPTABLE USE POLICY

You agree that you will only use Bloxino for purposes expressly permitted by these Terms of Service. Without our express prior written authorization, you will not:

  1. use the Services in any way that violates any applicable law, regulation, or treaty, including laws prohibiting illegal gambling, intellectual property laws, laws against obscene or defamatory speech, and laws protecting privacy and data protection;
  2. post, upload, or share Content that is harmful, threatening, abusive, vulgar, violent, indecent, harassing, hateful, racially or ethnically offensive, or otherwise objectionable;
  3. impersonate another individual or entity, falsely claim an affiliation, or misrepresent the source or identity of any information;
  4. engage in antisocial, disruptive, or destructive behavior, including "spamming," "flooding," "trolling," and "griefing";
  5. engage in platform manipulation, including utilizing bots or other fraudulent means to artificially drive traffic or generate engagements;
  6. circumvent, disable, or otherwise interfere with the operations of Bloxino or our security features;
  7. reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of Bloxino;
  8. access or use any automated process (such as a robot, spider, or scraper) to access Bloxino in violation of our robot exclusion headers;
  9. commercially exploit or make available the Services to third parties, including "framing" or "mirroring" Bloxino;
  10. take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
  11. attempt to do any of the acts described in this section or assist any person in engaging in any of the acts described in this section.

Engaging in any Prohibited Use may result in immediate suspension or termination of your account, including forfeiture of any BT, in our sole discretion. We may pursue any legal remedies against you, including civil, criminal, or injunctive relief.

8. BT, PAYMENTS, AND CASH-OUTS

BT are the single virtual currency used across Bloxino. BT are for entertainment purposes only and have no independent cash value. BT may be purchased using either cryptocurrency or Robux, as described below. Regardless of how they were obtained, all BT are the same single currency and may be cashed out only as Robux. BT are not eligible for refunds except as expressly set forth herein. BT may be deleted from inactive or terminated accounts.

8.1 Purchasing BT with Cryptocurrency

To purchase BT with cryptocurrency, you must send the required cryptocurrency to the wallet address provided by Bloxino at the time of purchase. Upon confirmation of the cryptocurrency transaction on the blockchain, the corresponding amount of BT will be credited to your account. The number of blockchain confirmations required will be displayed at the time of purchase. You are solely responsible for ensuring the accuracy of the wallet address and the cryptocurrency amount sent. Cryptocurrency transactions are irreversible. The purchase rate for BT is displayed on Bloxino at the time of purchase, and you may only purchase BT at the currently displayed rate. We reserve the right to change the purchase rate and accepted cryptocurrencies at our discretion.

8.2 Purchasing BT with Robux

To purchase BT with Robux, you initiate a purchase request on Bloxino for a specified amount of Robux. Bloxino facilitates a peer-to-peer gamepass transaction: you purchase a gamepass through Bloxino's platform, and the Robux are transferred to another user. Upon successful completion, the corresponding amount of BT will be credited to your account at the displayed conversion rate. You understand and agree that Robux purchases rely on the availability of a matching cash-out request from another user. We may postpone requests for so long as reasonably necessary. You understand that Roblox may charge marketplace fees on gamepass transactions, and such fees are your responsibility.

8.3 Cashing Out BT as Robux

BT may be cashed out only as Robux, regardless of how they were obtained. BT cannot be withdrawn, converted, or paid out as cryptocurrency or any other real-world currency. To cash out BT, you must have a Roblox experience in which you can create a gamepass. You create a gamepass and submit a cash-out request on Bloxino. Bloxino facilitates a peer-to-peer gamepass transaction: a purchasing user buys your gamepass, and the Robux are transferred to your Roblox account. You must own or control the Roblox account and experience associated with your cash-out. Cash-outs rely on the availability of a matching purchase request from another user. We may postpone requests for so long as reasonably necessary. You understand that Roblox may charge marketplace fees on gamepass transactions, and such fees are your responsibility. We may prohibit cash-outs for any reason, including fraud, conduct violations, technical errors, and hacking.

8.4 Cryptocurrency Risk Acknowledgment

By purchasing BT with cryptocurrency, you acknowledge that the value of cryptocurrencies is highly volatile and that there is a substantial risk of loss. Cryptocurrency values may be influenced by factors outside Bloxino's control, including market fluctuations, regulatory changes, and technical issues. Bloxino does not guarantee the value of any cryptocurrency. You are solely responsible for evaluating the risks associated with cryptocurrency transactions.

8.5 Anti-Money Laundering

We prohibit and seek to prevent money laundering and the funding of criminal activities. We monitor for suspicious transactions and may provide evidence of such activities to financial regulators or law enforcement. We may prevent you from creating an account, suspend or terminate your account, or request additional information if (1) you provide fraudulent account or payment information, (2) your transactions are flagged by our monitoring systems, or (3) you are on EU, UN, U.S. (OFAC), or similar sanctions or terrorism watch lists. You must wager at least one time (1x) the total amount deposited before cashing out any BT.

8.6 Refunds and Chargebacks

All purchases are final and nonrefundable. We reserve the right to address refund requests in our sole discretion. Cryptocurrency transactions are irreversible and are not eligible for refunds except in our sole and absolute discretion. If you initiate a chargeback or dispute, we may terminate your account and withhold or reverse any BT in your account.

8.7 Taxes

You are solely responsible for all applicable taxes associated with your use of Bloxino. If requested, you will provide us with a Social Security Number or Taxpayer Identification Number or any other required information for tax reporting purposes. You acknowledge that cryptocurrency transactions may have additional tax implications.

9. RULES OF THE GAMES

From time to time, we may offer certain Games on Bloxino. All Games are played using BT. We reserve the right to add, remove, or change the Games and their rules at any time, for any reason, without prior notice. The current rules of each Game are prominently displayed on Bloxino. Winnings from gameplay are credited as BT and, like all BT, may be cashed out only as Robux.

10. DISPUTE RESOLUTION AND DAMAGES

10.1 Governing Law and Venue

These Terms of Service shall be governed by the laws of the state of Florida, excluding its conflict of law provisions. All disputes must be resolved exclusively in the courts located in Orange County, Florida. The parties agree to exclusive jurisdiction and venue in Orange County, Florida, and waive any right to assert forum non-conveniens or similar doctrines.

10.2 Arbitration

If you have a dispute with Bloxino, you shall negotiate in good faith to attempt to resolve it. If unable to resolve the dispute through direct negotiations, either party must submit the issue to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be confidential and conducted in Orange County, Florida by a single arbitrator. The arbitrator shall have no authority to award punitive or exemplary damages, certify a class action, or vary the provisions of these Terms of Service.

10.3 Waivers

You hereby waive any right to initiate any class action or collective proceeding and any right to trial by jury.

10.4 Injunctive Relief

You acknowledge that remedies at law may be inadequate to provide us with full compensation in the event you breach these Terms of Service, and that we shall be entitled to seek injunctive relief in addition to all other remedies available at law or in equity.

11. DISCLAIMERS

11.1 We Disclaim All Warranties

We provide access to Bloxino "as is" and "with all faults." We disclaim all warranties, whether express, statutory, or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, and non-infringement. We do not warrant that Bloxino will be uninterrupted, timely, secure, or error-free.

11.2 Use at Your Own Risk

You expressly agree that access to Bloxino and use of the Services is at your own and sole risk. We do not guarantee that Bloxino will be free of viruses, malware, or other harmful code. You are solely responsible for any damage to your computer system or loss of data.

11.3 Third-Party Links

Bloxino may contain links to third-party websites. We have no control over and are not responsible for the content, goods, or services provided on third-party websites. Your use of third-party links is at your own risk.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Bloxino, its officers, directors, shareholders, employees, independent contractors, and agents, from and against any and all claims, actions, losses, liabilities, expenses, costs, or demands, including legal and accounting fees, resulting from your use of Bloxino, your violation of these Terms of Service, or your violation of any law or the rights of any third party.

13. LIMITATION OF LIABILITY

We will not be liable to you for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of Bloxino, even if we have been advised of the possibility of such damages. You discharge and release us from any and all claims relating to your use of Bloxino. Our total liability to you for any claim arising out of or relating to these Terms of Service or your use of Bloxino shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

14. INTELLECTUAL PROPERTY

14.1 Trademarks

Bloxino is our brand name and trademark. All marks, logos, and trademarks on Bloxino are our property or the property of their respective owners and may not be used without express written permission.

14.2 Copyrights

The Materials on Bloxino are our proprietary information and valuable intellectual property. The Materials may not be copied, distributed, republished, modified, uploaded, posted, or transmitted without our prior written consent.

15. GENERAL

15.1 Entire Agreement

These Terms of Service form the entire agreement between you and us concerning your use of Bloxino and supersede all prior agreements.

15.2 Assignment

We may assign any rights or delegate any performance under these Terms of Service without notice to you. You will not assign or delegate any of your rights or duties without our advance written consent.

15.3 Severability

If any provision of these Terms of Service is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force.

15.4 Force Majeure

We are not responsible for any failure to perform because of circumstances beyond our reasonable control, including acts of God, war, terrorism, strikes, failure of telecommunications infrastructure, hacking, malware, or any failure of a computer, server, network, or software.

15.5 Notices

Any notice required to be given by us may be provided by email or by a general posting on Bloxino. Notices by you to us shall be given by contacting us at support[at]bloxinox[dot]com.

15.6 Electronic Signatures

You agree that clicking on an "I agree," "I consent," or similarly worded button constitutes your legally binding electronic signature.

15.7 English Language

These Terms of Service are written in the English language. Only the English language version is binding. We are not liable
